| Joe Bully Oldies Puppy Purchase Agreement The buyer agrees to purchase the puppy ______________________from the litter by Joe Bully Oldies, out of (dam)_______________________and(sire)_______________________, born____________, for the amount of $_________ , plus shipping of $ ________. Buyer agrees to read this contract carefully, print out this form, sign it and send it to the seller, with their deposit of $500 made out to Sherri Kay Miller. Seller will sign the contract when it is returned and send a copy back to the buyer for their records. BUYERS INITIALS:_________ The seller agrees to furnish the buyer with the necessary health information, including all shot and worming records. The IOEBA WBA, and NBA registration application will be signed and executed at the time of purchase. The buyer understands that this puppy will be eligible for permanent registration. PET HOMES: All puppies purchased going to "Pet Homes", will be required to be spayed or neutered before 6 months of age and proof must be provided to Joe Bully Oldies. No exceptions. In addition, a Spay Neuter Contract will be signed by the Buyer along with this contract. Said contract must be signed and returned to Joe Bully Oldies along with purchase agreement. Registries will be notified of the agreement. Failure to abide by this agreement will result in buyer returning puppy at (buyers) expense, and buyer will pay any legal fee's (small claims court) incurred by seller retrieving the puppy. BREEDING RIGHTS: Joe Bully Oldies will screen all applicants purchasing a puppy for breeding purposes. Once screening is complete, and the Buyer is approved, Full breeding rights will be granted. This agreement will be listed on this document and signed by both parties and registries notified. Deposits/Payments/Shipping 1. Deposits can be made with, Paypal, Major Credit Card through Pay Pal, Wire transfer via Western Union, Walmart or Bank, and Cash. Once Joe Bully Oldies has received your deposit, the puppy will be marked and considered sold. 2. Choice of puppy is determined on a first come (deposit received) first to choose basis. Puppy will be placed on hold for five days, while waiting on deposit. If deposit is not received in that time, the puppy will be placed back for sale. Joe Bully Oldies reserves the right of first choice from any/and all litters. 3. Deposits are NON REFUNDABLE, except in the case of premature death, prior to the delivery of the puppy to you. In that instance any monies accrued will be refunded to you, or can be transferred to a future litter. If you change your mind and do not or cannot take your puppy, you forfeit your deposit. If you send an "open deposit” (a deposit that has been sent but no pup has been picked yet) and you can't get or don't want one from that litter then your deposit can go to the next litter. The remainder of the payment must be paid in full at 6 weeks of age if you are shipping or by cash only on the day the pup is picked up. We will start taking deposits on pups when they are 1 week old – unless you send an “open deposit". Pups are chosen in the order the deposits are received. Seller always has first choice and or "Pick" of the litter. 4. ALL SHIPPING COSTS ARE THE BUYERS RESPONSIBILITY. All shipping and remaining balance on the puppy must be paid at by 6 weeks of age. It should be noted that many airlines will not ship Bulldogges if the fore casted temperature is not within their guidelines , this can cause obvious delays in the shipping of your puppy. Ground Shipping is also available. All puppies will be shipped at 9 weeks of age. If unable to pick up or ship by then, additional kennel cost will be applied unless arrangements are made with Joe Bully Oldies. Joe Bully Oldies can make shipping arrangements for buyer at buyers request. 5.Any pup not picked up or shipped after the 12th week of age will have additional boarding fees of $35 a week, unless other arrangements have been made in writing with Joe Bully Oldies. The buyer will also be responsible for additional vaccinations, wormings, and any necessary veterinary care given while still in possession of Joe Bully Oldies. 6.Any puppy that has had a deposit and/or payments paid on that is still here with no contact from the buyer for two (2) weeks after the 12th week of age will be considered abandoned and buyer shall forfeit all monies paid to date and have no further claim to the puppy. Your Joe Bully Oldies Puppy is Guaranteed as Follows 1. To be in good physical condition for the first 48 hours after the time of delivery to the buyer. The buyer agrees to have the puppy examined by a Licensed Veterinarian within 48 hours after delivery time. If a veterinarian finds the puppy to have a serious physical condition other than a bacterial infection such as coccidia or giardia which is common and easily treated, the seller will replace the puppy with another puppy of comparable or better quality. The seller reserves the right to a second veterinarian opinion at the expense of the seller. If the puppy is not examined by a veterinarian within 48 hours after delivery time, the above guarantees are no longer in effect. No monies will be refunded. 2. To be free from any genetic/ hereditary defects that cause death or serious impairment of the vital functions in the puppy until said puppy is one year of age. If such an inheritable defect is documented by a Vet and after puppy is returned to seller for a second Vet opinion, and sufficient supporting evidence is found the buyer will be entitled to a replacement puppy of comparable or better quality, when available from an upcoming litter, after the first puppy is returned to seller. This guarantee does not cover what we consider normal problems in the Bulldog breed or problems beyond our control: Cherry Eye, Entropian (eye lids that turn in and irritate the eye), “Loose Hips”, or skin allergies, Localized Demodectic Mange, elongated soft pallet, or stenotic nares (collapsed nostrils). All of our dogs go through a physical performed by our veterinarian before each breeding takes place and the dogs are only bred if both are found to be healthy. We cannot guarantee that previous generations did not have these conditions in their lines. This guarantee is void if dog has been bred, altered, transferred, or euthanized without the seller’s written consent. 3. Before the puppy leaves our home, it will have received at least 1 vaccination and wormed 4 or more times. It is the buyers responsibility to continue scheduled vaccinations every 3 weeks until all puppy vaccinations are completed by a licensed Veterinarian. No replacement will be offered in case of Parvo, Corona, Distemper, or Kennel Cough. The pup has received proper vaccinations against these illnesses and none of these illnesses have been present at our kennel. Due to the highly contagious nature and rapid progression we cannot be held liable as the puppy may have been exposed after it left our care. The breeder has also started the pup on monthly flea control beginning at the age of 6 weeks and it is the buyer’s responsibility to continue use as of purchase date. It is also the buyer’s responsibility to start heart worm prevention for their puppy. BUYER INITIAL HERE:___________ Guarantee is Void in cases of Illegal Activity,(dog fighting) or extreme sports (weight pulling) or is mistreated, malnourished, or abused. And/or bred before 1 year of age. Guarantee is non transferable if dog is sold by buyer. At anytime Joe Bully Oldies reserves the right to refuse placement of a puppy or a dog with a buyer, for whatever reasons, and will terminate this contract. In this case any and all monies paid will be refunded to the buyer. Buyer agrees to the following: 1. To use the kennel name of "Joe Bully Oldies" as a prefix in the registration of the dog. 2. Maintain up to date vaccines, wormings, and keep the dog/pup in humane conditions, providing love, proper food, water and shelter. Buyer agrees to provide proper confinement for puppy, such as fenced yard, kennel or pen when outside, and a leash, lead/ or harness when in public at all times. Buyer agrees NOT to have puppy/dog on a chain at any time and also to no cropping of the ears. BUYERS INITIALS:___________ 3. If by chance you are unable to keep your puppy/dog, Joe Bully Oldies reserves the right to reclaim the dog, or we will help you find the dog a new home. (no refund implied). 4. This contract is valid only for the original buyer and dog, it is non-transferable. The dog must not be put down or transferred unless first contacting the seller. There is no guarantee or warranty that the buyer will be able to show or breed the dog regardless of show or breeding potentials. 5. At no time is the seller responsible for defects/conditions caused by buyers neglect, abuse, improper nutrition, mishandling or injuries to the pup/adult dog caused by said conditions. Seller declines any liability in the event of any accident involving the pup/dog which shall not be limited to dog bites or personal or property damage. BUYER INITIAL HERE:___________ The Buyer and Seller agree that this is the full and complete agreement that exists between the parties for the sale of this dog/puppy. Any agreements made prior to this are considered incorporated herein and any other modifications made to this agreement shall be made in writing or such shall not be effective.
